Class Action Lawsuits
Sometimes a large number of people are affected by a single wrong – a widely used defective product, an unfair service contract, patent abuse – essentially, a practice that a company engages in with a widespread negative effect on consumers or the industry. In these cases, if each person or company affected brought individual suits, the results might not be fair – some would win, some would lose, and those who brought suits near the end wouldn’t receive as much money as those who sued earlier. In these cases, therefore, class action lawsuits are considered to be the fair forum.
A “class” is nothing more than a group of people or companies – all those purchasing a certain car, for example, or all companies using an item that has a particular service contract. The class is identified and certified. The word is spread about the pending class action, and other people or companies who may also be eligible have the opportunity to join the class. The suit goes forth like any other lawsuit, but when it settles or there is a successful jury verdict, the damages are divided between the members of the class. This ensures that everyone who is deserving of damages receives the same damages.
