FEDERAL CRIMINAL OFFENSES
The "federal case" becomes very serious very quickly due to the federal sentencing guidelines that determine the range of the sentence. Depending on the number of months within the guideline range, a defendant may be sentenced to probation, house arrest or prison or penitentiary. It takes very little for one to become subject to the potential for imprisonment if charged with a Federal offense.
The defendant's prior record is also critical in the determination of the sentencing guideline range. A sentence is determined by computing the offense level and the criminal history category based on prior offenses.
CHARACTERIZATION OF OFFENSE
Federal criminal offenses are characterized as felonies and misdemeanors. Felonies are more serious and generally carry a guideline sentence range, requiring imprisonment. Misdemeanors are lesser violations, often resulting in only a probationary sentence.
